The appellant-sister had filed a suit for partition against her brother and mother. The suit was decreed and decree was challenged in Regular Civil Appeal No. 236 of 2007 before the Court of District Judge-III, Kolhapur wherein the decree of the trial Court was modified to the extent of her share in the suit property. It is against the decree of the Appellate Court, this Appeal is preferred.

Pending Appeal, respondent no.2 (mother of the appellant and respondent no.1) died. The parties have compromised the dispute and arrived at amicable settlement by drawing consent terms dated 31st January, 2019.

The appellant, respondent no.1 and their respective sons are present in the Court who have attested the thumb impression of the appellant and respondent no.1 respectively.

The appellant and respondent no.1 admit the execution of the consent terms and contents of it and are identified by their respective advocates. 4.

The consent terms are taken on record and marked 'X' for identification. The copies of Aadhar Card of the appellant and Election Card of respondent no.1 is taken on record and marked 'X-1' respectively.

The Appeal is disposed of in terms of the consent terms. The decree be drawn accordingly.
