The applicant is seeking regular bail in Crime No.847 of 2014 registered with Mahatma Phule Chowk Police Station, Kalyan, Dist-Thane for an offences punishable under Sections 420, 406, 467, 468, 471 read with 34 of the Indian Penal Code. 2.
The applicant was arrested on 13th September 2016 in the above referred crime.

Vide trying to make out the case for grant of bail, it is claimed that the applicants further detention is not warranted, in view of completion of the investigation. According to the learned counsel there is no direct evidence to connect the applicant to the N.S. Kamble page 1 of 2
3-ba-2351-2016 crime in question and would submit that the applicant is very much available for the prosecution.

The learned APP opposed the application and submits that looking to the nature of the crime committed by the applicant and the fact that the main accused since is absconding with whose connivance the applicant has committed the crime in question, it would be in appropriate to release the applicant. 5.
Upon perusal of the investigation papers what could be noticed is the applicant in connivance with the main accused who is absconding are trying to sold Government Land pretending it to be his. The applicant is the direct beneficiary of the forged practice as claimed in the FIR and other investigation papers. 6.
Since the main accused is absconding, the release of the present applicant will not be in the interest of justice particularly when due to prime-facie involvement of the applicant these is every likelihood that the applicant after release may help the main accused so as to destroy the evidence as could be inferred from the papers available.
