The learned counsel Mrs. P.H. Kantharia has submitted that on the last day i.e. on 19th June, 2018 itself, she had received instructions that the trial has commenced. She wanted to take instructions in respect of the stage of trial. 2.

On 27th June, 2018, the matter was adjourned at the request of the learned counsel for the Applicant. Today, learned counsel Mrs. Kantharia has submitted that even on 19th of June, 2018, one witness was examined. The accused in the present case had filed an application seeking discharge before the V.A. Tikam 1/2

High Court. The said application was rejected. It is also submitted that the accused-Applicant had made an application seeking transfer in the midst of recording of substantive evidence of PW-1.

In any case, since recording of evidence has commenced, it would not be appropriate to consider an application under section 439 of Cr.P.C. 4.
