Learned Counsel for the appellants submits that the parties have amicably settled the dispute between them and the trial Court has disposed of the darkhast proceedings by order dated 19.7.2017. The learned Counsel for the appellants submits that the appellants be allowed to withdraw the appeal alongwith amounts due and refund of Court fees, as per Rules.

The learned Counsel submits that the appeal is filed by four appellants, who are siblings and appellant No.1 be allowed to withdraw the entire amount on behalf of the other appellants. He submits that he is representing all the appellants. 1 / 2

Appeal is accordingly allowed to be withdrawn. Refund of Court fees as per Rules. Further, the oral prayer for withdrawal of the amount by appellant No.1 on behalf of the other appellants is allowed.

First Appeal and the Civil Application are disposed of accordingly.
