This matter is assigned to a Bench of Shri Justice N. H. Patil and Shri Justice A. A. Sayed. However, since they are not available, the Hon'ble Chief Justice has permitted mentioning of the matter before this Bench.

Learned counsel appearing on behalf of the Appellant submitted that the parties have amicably settled the dispute, and they have filed a petition for divorce by mutual consent under Section 13-B of the Hindu Marriage Act in the Family Court at Nashik. We have perused the copy of the said petition. In view of this, learned counsel 1 / 2

FCA. 308-14 appearing for the Appellant seeks leave to withdraw the appeal. Family court appeal is allowed to be withdrawn with liberty to the parties to proceed with the petition for divorce by mutual consent, which is filed by the parties in the Family Court at Nashik.
