1] This Petition takes an exception to the order dated 28.09.2017 passed by the learned Principal District Judge, in Civil Miscellaneous Application No.9 of 2017.

2] Above Civil Miscellaneous Application No.9 of 2017 was filed for transfer of Special Civil Suit No.45/2016 which, at the relevant time was pending in the Court of Principal Civil Judge, Senior Division, Thane, to any other Court. The said application came to be rejected by the order impugned.

3] The transfer of suit was sought on the ground of bias. After lapse of five years there arises no question of entertaining the present Petition as concerned Presiding Officer must have been transferred by now. Hence, the Petition is dismissed.
