1] By an Order dated 19th October 2018, the applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates, to join the process of investigation. 2] Heard the learned counsel for the applicant and the learned APP for the State. Perused the record of investigation. 3] The record indicates that, the applicant was appointed as Additional Director of the Company known as M/s Avon Corporation Ltd on 30.5.2013 and was made permanent Director of the said Company on 30.9.2013. The informant and other witnesses have deposited/invested the 1/2

aba.2164-2018.doc amounts with the said Company, in the year 2011 i.e. much prior to the appointment of the applicant as Director. Prima facie, there is no material available on record to indicate that, the applicant was either the signatory to the any of the contract or induced the witnesses to deposit the amounts in the said Company by misrepresentation. No material is available on record to indicate that, the applicant misrepresented any of the witnesses and/or informant to deposit the money with the said Company. 4] The record indicates that, in pursuance of Order dated 19th October 2018, the applicant attended Investigating Officer and has cooperated in the process of investigation. In view thereof, interim relief granted by Order dated 19th October 2018 is hereby confirmed. However, the condition to attend the Investigating Officer is waived.
