1] The applicant (Original respondent in appeal) is permitted to withdraw the entire amount deposited by the appellant before the MACT, Mumbai along with interest accrued thereon after furnishing of bank guarantee from a nationalized bank to the satisfaction of the Presiding Officer of the MACT, Mumbai. The bank guarantee is to be kept alive until disposal of this appeal and shall abide by any further orders that shall be made in the main appeal. 2] It is made clear that such withdrawal is without prejudice to the contentions raised by the applicant in first appeal no. 52 of 2014, wherein he has applied for enhancement of compensation. 3] Civil application is disposed of in the aforesaid terms.
