This is an application for modification of the condition imposed upon the Applicant by an Order dated 29.02.2016.

The Applicant was granted bail by an Order dated 23.07.2014 and was directed to attend the Trial Court on every Monday till the conclusion of trial. The said condition was subsequently, modified by an Order dated 29.02.2016 and the Applicant is directed to attend the Trial Court on every first and third Monday between 11.00 a.m. to 1.00 p.m. till conclusion of the trial. The learned Counsel for the Applicant submitted that this Court in the case of co-accused in Criminal Application No. 429 of 2017 has modified the said condition and has directed the Applicant therein to attend the Trial Court on the Sneha Chavan 1/2

29 appp 1037-17=.doc dates given by the Trial Court. He further submitted that till date, the trial has not commenced.

The record indicates that since his release from jail, the Applicant is sincerely complying with all the conditions imposed upon him. That in view of the Order passed in Criminal Application No. 429 of 2017, the Applicant also deserves to be given benefit of the same.

In view of the circumstances of the present case and in the interest of justice, the Order dated 29.02.2016 is hereby modified and the Applicant is directed to attend the Trial Court on the stipulated dates given by the Trial Court.
