Heard. By this petition under Article 227 of the Constitution of India the Petitioner husband challenges the order dated 22.08.2013 passed by the learned District Judge, Alibaug in Civil Inquiry Application No.10/2013 directing the petitioner to hand over custody of minor child Kum. Vaishnavi to respondent wife.

The learned counsel for the petitioner submits that thereafter the respondent wife filed application for withdrawal of her earlier Civil Enquiry application No.10/2013 which was allowed by the Trial Court on 18.12.2013. The learned counsel for the petitioner placed on record certified copy of order dated 18.12.2013 and other proceedings. Same is taken on record and marked "X" for identification.

In view of subsequent development that the respondent wife withdrew her application for custody of child, nothing survives in the Writ Petition. Hence, the Writ Petition stands disposed of as infructuous. No order as to costs.
