IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CRIMINAL APPELLATE JURISDICTION WRIT PETITION NO. 4637 OF 2017 Ravindra Ram Murut Dwivedi ....Petitioner.
Vs.
Naresh Goel and others.
....Respondents.
Mr. A.K.Prajapati for the Petitioner.
Mr. S.S. Hulke, APP, for the Respondent-State. CORAM :A. S. GADKARI, J.
DATE : 27th AUGUST, 2018.
P.C.:- 1.
The complaint as drafted and presented before the Additional Chief Metropolitan Magistrate impleading the Hon'ble Prime Minister of India appears to have been filed without bonfide intention. It prima facie appears from the record that, the said complaint is frivolous and therefore, the learned Additional Chief Metropolitan Magistrate, 22nd Court, Andheri, Mumbai by its impugned order dated 18.4.2017 has rejected it. The Criminal Revision Application No.145 of 2017 has been rightly dismissed by the learned Additional Sessions Judge, Borivali Division, Dindoshi, Goregaon, Mumbai. There are concurrent findings recorded by both the Courts below. There is no error either in law or on facts committed by both the Courts below in passing the impugned Orders. 2.
Perusal of the record would indicate that, interference of this Court under Article 227 of the Constitution of India is unwarranted. 1/2
