1] After hearing the learned counsel for the applicant at length, when this Court was not inclined to grant relief, the learned counsel on instructions seeks leave to withdraw the present application with liberty to file a fresh application for bail before the Trial Court, if the trial arising out of CR No.I-324 of 2016 registered with Vitthalwadi Police Station, District Thane now culminated into Sessions Case No.84 of 2017 pending on the file of the learned Additional Sessions Judge, Kalyan does not commence within a period of one year from today.

Leave and liberty granted.
