DATE : 22 JANUARY 2020 P.C.:- By this Petition, the Petitioner challenges the order dated 9 September 2014 whereby the Petitioner was held to be ineligible for appointment on the post of Kotwal, from Scheduled Tribes category.

The advertisement for the said recruitment had a condition that after appointment within three months, the Petitioner should produce the Caste Validity Certificate. The Petitioner fail to do so. Therefore, the impugned order was passed. 3.

The Petitioner did not approach this Court within the period of three months if it was not possible for the Petitioner to 1/2

59 wp 373-15.doc produce the Caste Validity Certificate in time. As far as the authorities are concerned they were bound by the condition imposed in the advertisement and therefore proceeded to discontinue the services of the Petitioner.

In these circumstances, we do not find any error in the decision taken by the Respondents to find the Petitioner ineligible for continuation on the post.

Writ Petition is accordingly rejected.
