t have any instructions. Hence, he is seeking time.

It is to be noted that, earlier also the matter was adjourned at the request of advocate for the petitioner only, therefore, there is no question of granting any adjournment again.

Learned counsel for the Respondent No.6 submits that, in view of the subsequent development, nothing survives V.B.Gokhale
16-wp-12344-17 in the present writ petition. He submits that, by this Writ Petition under Article 226 of the Constitution of India, the petitioner is seeking direction to the Collector, Thane to withdraw the impugned order / communication dated 26/10/2017, thereby directing the Sub Divisional Officer, Ulhasnagar to initiate criminal proceedings with respect to subject matter properties. He submits that, the said communication is complied with by the authority by filing an FIR No. I 315 of 2017 with the Central Police Station, Ulhasnagar on 10/11/2017. He further submits that, the petitioner has also filed Criminal Application No.41 of 2019 for quashing the said FIR. Therefore, nothing survives in the present writ petition.

Considering the fact that the learned counsel for the petitioner don't have any instructions to proceed with the matter and the order-communication dated 26/10/2017 is already acted upon, nothing survives in this petition. 6.
Hence, the Writ Petition stands dismissed as infructuous.

No order as to costs.
