Heard Mr. Sandeep Salunkhe, learned counsel for the petitioner and Mr.Nilesh Wable, learned counsel for the respondent at length. Rule. Mr.Wable waives service for the respondent. At the request and by consent of the parties, Rule is made returnable forthwith and petition is taken up for final hearing.

By this Petition under Article 227 of the Constitution of India, the petitioner/wife has challenged the Judgment and order dated 24.10.2016 passed by the learned Principal District Judge, Pune below Exhibit-1 in Civil Misc. Application No. 574 of 2016. By that order, the learned Judge rejected the application made by the wife under Section 24 of CP.C. for transferring H.M.P. No.158 of 2014 filed by the respondent-husband in the Court of Civil Judge, Senior Division, Baramati to the Court of Civil Judge,

Mr.Wable states that by consent of the parties, impugned order may be set aside. In view thereof, by consent of the parties, impugned order dated 24.10.2016 is set aside. Civil Misc. Application No. 574 of 2016 is allowed. Proceedings of H.M.P. No.158 of 2014 pending on the file of learned Civil Judge, Senior Division, Baramati shall stand transferred to the Court of Civil Judge, Senior Division,Pune.

Respondent is at liberty to file application for disposal of the proceedings in a time bound manner. If such application is made, the learned trial Judge will pass appropriate order. 5.

Rule is made absolute accordingly with no order as to costs. All parties including the trial Court to act on the authenticated copy of this order.
