This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 51 of 2021, registered at Wanvadi Police Station, Pune City, for the ofences punishable under Sections 307, 452, 323, 504, 506 read with 34 of the Indian Penal Code (IPC), Section 34(1)(3) read with 135 of the Maharashtra Police Act and Section 4 read with 25 of the Indian Arms Act.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

According to the prosecution, on the date of incident which took place on 07 February 2021, the present applicant and other co-accused attempted to commit the murder of the husband of the complainant by assaulting him by knife as he objected to the acts of applicant and other co-accused of playing cards near Darshan P. 922-ba-3691-22.doc public toilet. In the incident, the daughter of the brother of the complainant appears to have sustained injury. 5.
I have perused the injury certifcate. The nature of the injury is simple. The applicant is in jail for more than two years and the trial has not yet commenced. Learned APP submits that the applicant is involved in six more crimes. However, considering the facts and circumstances, I am inclined to release the applicant on bail on certain conditions. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant- Karan Sunderlal Valmiki be released on bail, in C.R. No. 51 of 2021, registered at Wanvadi Police Station, Pune City, for the ofences punishable under Sections 307, 452, 323, 504, 506 read with 34 of the IPC, Section 34(1)(3) read with 135 of the Maharashtra Police Act and Section 4 read with 25 of the Indian Arms Act, on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount. C] The applicant shall not enter into the municipal limits of Pune City till conclusion of trial, except to attend the dates before the trial court.
D] The prosecution is at liberty to fle an application for cancellation of bail, if the aforesaid condition is breached. [N.R.BORKAR, J.] Darshan P. Patil 2/2
