It was submitted before Hon'ble Justice Revati Mohite Dere that the applicant would surrender before the Investigating Officer within two days from 14 March, 2016. The applicant has not abide by the said understanding and has instead filed an application under Section 438 of the Code of Criminal Procedure. Hon'ble Justice Smt. Revati Mohite Dere has specifically observed that the application is not granted, qua Applicant Nos.1 and 2 will surrender before the Investigating Officer, within two weeks, and therefore, Hon'ble Court has directed the learned Registrar to decide the application on its own merits. The application stands dismissed.
