The above Writ Petition has been filed for a direction to the Respondent Nos.1 and 2 to register an FIR in respect of the incident which has taken place on 29/10/2017. In so far as the said incident is concerned, the statement of the Petitioner has been recorded on the said date. It seems that acting upon the said statement, the Wakad Police Station, Pune has registered an N.C. Aggrieved by the said fact that the Petitioner has approached this Court as according to the Petitioner a cognizable offence punishable under Section 447 of the Indian Penal Code has been made out. We restrain ourselves from expressing any opinion on the basis of the statement of the Petitioner whether any cognizable offence is made out or not. We however direct the police to consider the said statement of the Petitioner and thereafter satisfying themselves as regards the title of the lgc

(909) wp-4644.17 Petitioner to the property in question take appropriate action in accordance with law uninfluenced by the fact that an N.C. has been registered earlier. The same to be done within 4 weeks from date. The decision to be communicated to the Petitioner within one week of such decision being arrived at. With the aforesaid directions, the above Writ Petition is disposed of. Parties to act upon a copy of the order duly authenticated by the Court Shirestedar.
