The learned Counsel for respondent no.6 points out that the petitioner has already instituted an appeal before the Additional Collector against the order dated 24/08/2015 which is impugned in the present petition.

Perusal of the petition indicates that there is no disclosure with regard to the filing of such appeal. Since the appeal is already pending against the impugned order, there is no necessity to entertain the present petition. The petitioner is however at liberty to pursue the pending appeal.

The authority before whom the appeal is pending, is directed to decide such appeal in accordance with law and on its own merits.
