The learned APP, upon instructions, submits that in the trial in Sessions Case No.218 of 1999, three witnesses are examined by the prosecution. The co-accused have been convicted. The trial was separated as far as the present applicant was concerned. Since the trial has commenced, it would not be appropriate to consider the application under Section 439 of Cr.P.C.

Application stands disposed of.
