Ms Prabhala, learned counsel appearing for the Applicant submits there is a delay of 95 days in filing the first appeal challenging the impugned judgment and award dated 05/03/2015 passed by the learned Member, Motor Accident Claims Tribunal, Mumbai in Claim Application No.2176 of 2008.

The learned counsel for Respondent No.1 opposes the present application.

After going through the application, wherein the Applicant has stated that because there are different departments and before filing the appeal, it required to obtain sanction and complete other formalities, therefore, the time consumed in the completion of all the process is the reason for causing delay in filing the first appeal. 6.
In absence of any reply opposing the present application or disputing the facts stated in the application, I have found that the reasons stated in the application are satisfactory. Accordingly, I pass the following order:-
ORDER
(i) The application for condonation of delay is allowed; (ii) The delay caused in filing First Appeal is condoned. The office is requested to register the First Appeal and place the same before the Court for admission.
