Heard learned Counsel for the Petitioner and learned APP for the Respondent-State.

The petition is filed seeking transfer of investigation in connection with F.I.R. 330 of 2016 from Amboli Police Station to any other Investigating Agency, including Crime Branch/CID. 3.

The main grievance of the Petitioner is that, though the FIR also discloses serious offence under Sections 447, 397 of the Indian Penal Code, the same was registered only under Sections 143, 145, 147, 149, 448, 323, 504 and 506 of IPC.

On the last occasion, learned APP pointed out that investigation into the said FIR is complete and sought time for further investigation under Section 143 of the Criminal Procedure Code. Mrs. Deshmukh, upon instructions from the Senior Police Inspector, Amboli Police Station, Mumbai, makes a statement that Sections 457, 458 and 395 have been added in the said FIR. In support of her statement, she places on record letter dated 26 April 2017 by Senior Police Inspector, Amboli Police Station, Mumbai. Mrs. Deshmukh also makes a statement that further investigation will be carried out for offences covered by the above sections and needful will be done as expeditiously as possible. Statement accepted. In the light of above, Mr. Kulkarni, learned Counsel for the Petitioner, fairly states that the grievance of the Petitioner at this stage does not survive.
