Applicant is seeking enlargement on bail in Crime No. I 127 of 2018 registered with the Hill Line - Police Station, for the alleged offences punishable under Sections 395, 397, 363, 323, 504, 506 r/w 34 of the Indian Penal Code, 1860.

It is alleged on 23.05.2018. The complainant 1/3

was assaulted by the applicant by wooden log. The another accused robbed him of Rs. 8,500/-. The complainant had suffered a fracture of left hand, as could be seen from the injury certificate. Besides, two offences are registered against the applicant in the year 2013 and 2014. Five non-cognizable complaints are also filed against him.

The investigation in the case is over and the charge-sheet is filed. The case is committed to the learned Sessions Court in November, 2018.

The applicant is in custody since May, 2018 and then trial is not likely to commence and conclude in the near future.

The applicant is directed to be released on bail on the following conditions :

O R D E R

(i) The applicant is directed to be released on bail in Crime No.I 127 of 2018 registered with the - Hill Line Police Station , on executing P.R. Bond 2/3

in the sum of Rs.25,000/- with solvent surety in the like amount;

(ii) Applicant undertakes that he shall live, out of Thane District and affidavit shall be filed on or before 03.01.2020 in this Court;

(iii) The applicant shall furnish his residential address as well as permanent address and mobile number to the investigating officer within ten days from his release on bail;

(iv) The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case;
