Both the learned counsel state that the proceedings are still pending before the Magistrate even for consideration of interim relief and no adverse order is passed in favour or against either of the parties.

In this case, it would be appropriate if the Magistrate is directed to decide the question of interim relief within a time bound manner. Both the learned counsel agree that if such an order is passed, this Petition may not be decided in the High Court at this stage. Bhalchandra

Considering these submissions, the Petition is allowed to be withdrawn. The learned Magistrate is directed to decide the question of interim relief within a period of three months from today. It is made clear that the contention of both the parties and all the questions are specifically left open. Disposal of this Petition will not come in favour or against either of the parties, in either way. 4.
