The learned Counsel appearing for the petitioner on instruction seeks permission to withdrawn the petition with liberty to prosecute the appeal dated 9th November 2015 a copy of which is annexed as Exhibit 'E' to the affidavitinreply of Shri Rajendra Jayram Jadhav, Joint Commissioner, Fisheries. 2.
Accordingly, we dismiss the petition as withdrawn with liberty as prayed. All contentions of the petitioner in the said pending appeal are kept open. We direct the Appellate Authority to Habeeb 1/2

Even if a copy of this order is not available, we direct the office of the Government Pleader, High Court Appellate Side, Bombay, to communicate this order to the concerned Appellate Authority who shall act upon the communication received by the Office of the Government Pleader. The Civil Application No. 1620 of 2016 does not survive and hence disposed of.
