This civil application is filed by the original claimant for withdrawal of the amount deposited by the appellant insurance company. This is an injury claim. The learned Counsel for the applicant has submitted that till today, no amount is received by the applicant / injured person and he has incurred expenses towards treatment.

In view of the above, the applicant is allowed to withdraw a sum of Rs.30,000/- out of the total deposited amount of Rs.58,000/- on a usual undertaking to be furnished by the applicant. Balance amount shall be invested in a fixed deposit of any nationalised bank. 1 / 2
