This is an application under Section 438 of the Cr.P.C. filed by the aforesaid Applicant, apprehending his arrest in Crime No.211 of 2022 registered with Malegaon Chavni Police Station, Nashik Rural for the offences punishable under Sections 419 and 420 of the IPC. 2.

The aforesaid crime was registered pursuant to the FIR lodged by Bharat Maval, Assistant Motor Vehicle Inspector, Malegaon. The Complainant has alleged that on 19/10/2022 and 20/04/2022 the Applicant herein answered test for attending learners license by impersonating himself to be Padmabhushan Shankar Pagar and Chandrakant Ashok Sonawane. The allegations levelled against the 1/3

Applicant prima facie constitute offences punishable under Section 416 of the IPC, which is punishable with maximum imprisonment of three years. Applicability of Section 420 prima facie appears to be doubtful. 3.

The nature of accusations against the Applicant, in my considered view does not warrant custodial interrogation. Hence, the Application is allowed on the following terms and conditions: (i) In the event of arrest of the Applicant in Crime No.211 of 2022 registered with Malegaon Chavni Police Station, Nashik Rural, the Applicant shall be released on bail on executing PR bonds in the sum of Rs.20,000/- with one or two sureties to the like amount;

(ii) The Applicant shall report to the concerned Investigating Officer for a period of four days from 28/11/2022 between 11.00 a.m. to 2.00 p.m. and thereafter as and when required by the Investigating Officer.

(iii) The Applicant shall keep the Investigating Officer 2/3

informed of his current address and mobile contact number, and /or change of residence or mobile details, if any, from time to time.
