We have heard Ms. Chavan, an appointed counsel appearing for the petitioner, for sometime.

The prayer for grant of leave by the petitioner-convict was allowed by the Superintendent of Nashik Road Central Prison subject to the petitioner bearing the necessary charges. 3.
Since the amount was informed to be exorbitant, the petitioner was unable to avail the said benefit particularly which was extended to him in view of death of his father.

Considering the very cause for which the leave was sanctioned is extinguished and in view of the provisions of Prisons (Bombay
bipin prithiani 26-wp-4120.22.doc Furlough and Parole) Rules, 1959, particularly, Rules 12 and 21, the petitioner being a convict for an offence punishable under Section 376(d) with the provisions of Sections 6 and 8 of the POCSO Act is not entitled for the relief. Nothing survives in the petition. As such, petition stands disposed of.
