This Application is filed for leave to appeal against the order of acquittal. By the impugned order, the Additional Sessions Judge, Solapur acquitted the Accused of the offences punishable under Sections 363, 366A read with Section 109 of IPC. On the basis of evidence, the learned Additional Sessions Judge, Solapur came to conclusion that the prosecution failed to prove that Respondent No.1 instigated or induced victim girl to accompany him with the promise of marriage or kidnapped her from lawful guardianship of her parents on account of Shivgan 1/2
26-ALS-129-2016.doc inducement of marriage. View taken by the learned Additional Sessions Judge, Solapur is a possible view and, therefore, we are not inclined to interfere and the Application for leave to appeal, accordingly, stands dismissed.
