This is an application under Section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in Crime No.497 of 2022 registered with Baramati City Police Station, Pune Rural for the offences punishable under Sections 323, 498-A, 354, 377, 504 r/w 34 of the IPC.

Heard Mr. Barge, learned counsel for the Applicant, Mr. Palkar, learned APP for Respondent -State and Mr. Rupesh Zade, learned counsel for the Intervenor. I have perused the records and 1/3
considered the submissions advanced by the learned counsel for the respective parties.

The records prima facie reveal that the Complainant was married to the son of the Applicant on 01/12/2020. The Complainant left the matrimonial house in April-2022 and lodged the FIR in October-2022 alleging that she was subjected to harassment and cruelty by her husband and his family members. Accusations against the Applicant are that she used to insult her and give her stale food to eat. The accusations against the Applicant, who is mother-in-law of the Complainant, are general in nature and would not warrant custodial interrogation.

Under the circumstances, the application is allowed on the following terms and conditions:- (i) In the event of arrest of the Applicant in Crime No.497 of 2022 registered with Baramati City Police Station, Pune Rural, the Applicant shall be released on bail on executing PR bonds in the sum of Rs.20,000/- with one or two sureties to the like amount;

(ii) The Applicant shall report to the concerned Investigating Officer for a period of two days from 28/11/2022 between 3.00 p.m. to 5.00 p.m. and thereafter as and when required by the Investigating Officer.
(iii) The Applicant shall keep the Investigating Officer informed of her current address and mobile contact number, and /or change of residence or mobile details, if any, from time to time.

The application stands disposed.
