Heard learned counsel for petitioner and learned APP. The petition is filed seeking direction to respondent no.1 to register an first information report against respondent nos.2 to 4 on the basis of petitioner's complaint dated 25th February 2012, a copy whereof is annexed at Exhibit-E, page 50 of the paper book. 2.
Learned APP, on instructions of Mr.Sharad Ugale, ACP, Vishrambaug Division, Pune, makes a statement that the said complaint of the petitioner could not be inquired into for want of his co-operation. He submits that time and again, the petitioner was called for inquiry, but he did not co-operate. The statement is, however, disputed by the petitioner.

In the above circumstances, learned counsel for petitioner having taken instructions from the petitioner, who is present in the Court, states that the petitioner will attend the office of Assistant Commissioner of Police, Vishrambaug Division Mr.Sharad Ugale (who is also holding charge of Deccan Division, Pune), on Monday, 9th October 2017 at 11 a.m.. The statement is accepted. 4.
In the event petitioner approaches Mr.Sharad Ugale, as stated above, Mr.Ugale shall conduct preliminary inquiry in the petitioner's complaint and take appropriate decision and communicate the same to the petitioner within seven days from 9th October 2017. 5.
