Heard. This is an application under Section 438 of Cr.C. The applicant herein is apprehending his arrest in C.R.No.68 of 2017 registered at Pachgani Police Station for the offences punishable under Sections 467, 468, 471 of the Indian Penal Code.

After arguing at length, the learned counsel for the applicant seeks liberty to withdraw the application with further liberty to appear before the Magistrate at Pachgani on or before 8.2.2018. The learned counsel for the applicant vehemently submits that the applicant is 76 years old and is infirm. In view of this, the learned Magistrate may consider the
