Heard learned counsel for the applicants.

Learned APP submits that despite issuance of notice under Section 41A of the Code of Criminal Procedure (hereafter 'the Cr.PC' for short), the applicants failed to appear.

The offence registered against the applicants is under 1/2

5 & 6. ABA 3257-2022.doc Sections 406, 420 read with 34 of the Indian Penal Code vide C.R.No.0714 of 2022 at Tardeo Police Station. 4.

The applicants have stated in Ground (e) that they are ready and willing to pay an amount of Rs.29,50,000/- after getting deductions of damaged laptops and scratches cost. According to learned counsel for the applicants, the transaction is of civil nature. Learned counsel for the applicants submits that they are willing to co-operate with the investigation. The applicants undertake to respond to the notice under Section 41A of the Cr.PC and appear before the Investigating Officer.

The applicants to report to the Investigating Officer on 26th, 27th and 28th November, 2022, between 11.00 a.m. and 1.00 p.m. and thereafter, as and when called. In case the Investigating Officer wants to effect arrest in the wake of the reasons recorded by him, he shall give 72 hours notice in advance to the applicants.

The applications are disposed of.
