DATED : 3 APRIL 2023 P.C. :- This is an application filed under Section 438 of the Code of Criminal Procedure, 1973 for anticipatory bail. 2.

The applicant is apprehending his arrest in Crime No. 607 of 2022 registered at Panvel Police Station for the offences punishable under Sections 306 r/w 34 of the Indian Penal Code. 3.

I have heard the learned counsel for the applicant, the learned APP for the respondent-State and the learned counsel for the complainant/intervenor.

This Court by order dated 18 November 2022 in Anticipatory Bail Application No. 3221 of 2022 has granted anticipatory bail to the coaccused in the present crime. For the reasons recorded in the said order MJ Jadhav 1 / 2

31-ABA-3259-22.odt and in view of the Consent Terms filed by the parties, I am inclined to grant anticipatory bail to the applicant. Hence, the following order is passed:

(i) Application is allowed.

(ii) In the event of arrest of applicant in Crime No. 607 of 2022 registered at Panvel Police Station for the offences punishable under Sections 306 r/w 34 of the Indian Penal Code, he shall be released on bail on furnishing PR bond in the sum of Rs. 25,000/- with one or two sureties in the like amount subject to payment of Rs. 25,000/- to Maharashtra Police Welfare Fund- A/C : 914010029005759, IFSC Code No. UTIB0000060.
