The pre-arrest bail is sought by the applicant in respect of the C.R.No. 723 of 2022 registered with Tardeo Police Station for the offence punishable under Section 420 read with 34 of the Indian Penal Code read with Sections 4, 5 12(A) of the Maharashtra Prevention of Gambling Act read with Section 7 of the Bombay Racecourse License Act, 1912.

Learned APP, on instructions, makes a grievance that despite issuance of notice under Section 41A of the Code of Criminal Procedure (hereafter 'the Cr.PC' for short), the 1/2

Learned counsel for the applicant submits that the applicant has no intention to defy the notice under Section 41A of the Cr.PC and assures that all possible cooperation will be rendered while responding to the notice under Section 41A of the Cr.PC.

In this view of the matter, the applicant to report to the Investigating Officer on 26th, 27th and 28th, November, 2022, between 11.00 a.m. to 1.00 p.m. and thereafter, as and when called. The applicant to co-operate. 5.

In case the Investigating Officer seeks arrest of the applicant, he shall give 72 hours notice to the applicant. 6.

The applicant to furnish details of residential address and contact numbers to the Investigating Officer. 7.

The application is disposed of.
