This is an application under Section 438 of Cr.P.C. filed by the aforesaid Applicant apprehending his arrest in C.R. No.380 of 2022 registered with Vimantal Police station, Pune City, for the offences punishable under Sections 387, 504 and 506 of the Indian Penal Code. 2.
Heard Mr. Raja Thakare, learned senior counsel for the Applicant and Ms V. Shinde, learned APP for the Respondent -State. I have perused the records and considered the submissions advanced by the learned counsel for the respective parties. 1/3

The aforesaid crime was registered pursuant to the FIR lodged by Kaluram Khandve. The Complainant has alleged that on 18/09/2022 @ 10.05 a.m. the Applicant, who was under the influence of alcohol demanded extortion money of Rs.5,00,000/-. The Applicant is also alleged to have assaulted the Complainant. 4.
The records reveal that the Applicant had lodged a complaint against the brothers of the Complainant. Pursuant to the said complaint crime has been registered against Kalidas and Mauli and others for offences punishable under Sections 143, 147, 148, 307 and 341 r/w. 149 of the IPC. The subject crime has been lodged on 05/10/2022, after considerable delay. The possibility of the complaint being lodged as an afterthought or as a counterblast, prima facie cannot be ruled out.

Considering the above facts and circumstances, particularly, the nature of accusations, in my considered view this would not be a fit case which would justify custodial interrogation. Hence, the application is allowed on the following terms and conditions :- (i) In the event of arrest of the Applicant in C.R. No.380 of 2022 registered with Vimantal Police station, Pune City, the Applicant shall be released 2/3
on bail on executing PR bonds in the sum of Rs.20,000/- with one or two sureties to the like amount;
(ii) The Applicant shall report to the concerned Investigating Officer for a period of two days from 28/11/2022 between 11.00 a.m. to 3.00 p.m. and thereafter as and when required by the Investigating Officer.
(iii) The Applicant shall keep the Investigating Officer informed of his current address and mobile contact number, and /or change of residence or mobile details, if any, from time to time.

The application stands disposed of.
