Heard learned counsel for the applicant and learned APP for the State.

A notice under Section 41A of the Code of Criminal Procedure (hereafter 'the Cr.PC' for short) has already been issued. In compliance thereof the applicant submits that he has reported to the Investigating Officer. However, learned APP submits that further statement of the applicant needs to be recorded.

The offence is punishable under Sections 323, 406, 498-A, 504, 506 read with 34 of the Indian Penal Code. The 1/2

As the notice under Section 41A of the Cr.PC has already been issued, the same needs to be taken to its logical conclusion. Learned APP submits that the same would be accordingly done by the Investigating Officer. 4.

The applicant to report to the Investigating Officer on 1st and 2nd December, 2022, between 11.00 a.m. and 1.00 p.m. and thereafter, as and when called. In case if the Investigating Officer wants to effect the arrest if he feels that arrest is imperative in the wake of the reasons recorded by him, he may effect the arrest after giving 72 hours notice in advance to the applicant. The applicant to furnish the details of his residential address and contact numbers to the Investigating Officer.
