Heard Ms.Nasreen Ayubi appointed Advocate appearing for applicants. She argued that applicants are apprehending bias and, therefore, they want the Sessions Case in which they are arraigned as accused to be transferred to some another learned Additional Sessions Judge at Nashik. I have also heard the learned Additional Public Prosecutor for the respondent/State.

It is seen from the arguments advanced by the parties, as well as, pleading in the application sent through jail that Gaikwad RD 1/2

(11)APPLNNo.6882016 (1) applicant/accused are seeking transfer of the pending Sessions Case from one learned Additional Sessions Judge to another learned Additional Sessions judge. As such, the applicant can very well raise this grievance by filing appropriate proceedings before the learned Sessions Judge at Nashik.

In this view of the matter, the application is rejected. Inform applicants/accused accordingly.
