None appears for the petitioners. Perused the paragraphs 4 and 5 of the affidavit of Shri. Bhimrao P. Khode dated 17th January, 2014 filed on behalf of the Nashik Municipal Corporation. It is stated therein that in view of the subsequent proposed modification to the development plan and in view of the notification dated 04th September, 2013, the main challenge in this Writ Petition under Article 226 of the Constitution of India to the earlier notification dated 12th December, 2007 does not survive.
