The applicants had preferred applications for anticipatory bail before the Sessions Court, Sangli in connection with CR No.211 of 2018, which were allowed by order dated 1st December 2018 in Criminal M.A.Nos.1170 of 2018, 1171 of 2018 and 1172 of 2018 below Exhibit-1 respectively. The applicants were directed to attend concerned Police Station and the Investigating Officer on every Sunday between 10 am to 12 pm and to co-operate in investigation till filing of charge sheet. It is contended that the applicants have thereafter complied the said condition. Subsequently the applicants preferred Criminal Miscellaneous Application No.65 of 2019 for relaxation of said condition before Sessions Court. By order dated 4th June 2019 the condition No.2(a) was modified and applicants were directed to attend Police Station every fortnight. 2.
Learned counsel for applicants submitted that proceedings are challenged before this Court by preferring Writ Petition No.87 of Corrected version of order dated 5-12-2019, pursuant to Speaking to Minutes order dated 17-1-2020
2 of 2 911.APPLN.384.2019.STM.doc 2019 and the same are pending. By way of interim order this Court had directed that though investigation may continue, charge sheet should not be filed. It is therefore submitted that condition of reporting may be relaxed. Taking into consideration the aforesaid circumstances, the condition of reporting can be modified. Hence, I pass following order :
ORDER
(i) The order dated 1st December 2018 passed by DJ-5/Additional Sessions Judge, Sangli in Criminal M.A.Nos.1170 of 2018, 1171 of 2018 and 1172 of 2018, as well as order dated 4th June 2019 passed by Additional Sessions Judge, Sangli in Criminal M.A.No.65 of 2019 stands modified and the condition of reporting to Police Station/Investigating Officer stands relaxed. However, the applicants are directed to report the Investigating Officer as and when called; (ii) All other conditions stipulated for grant of bail by Sessions Court shall remain intact;
