Heard the learned Additional Public Prosecutor in support of the application. The learned Additional Public Prosecutor fairly submits that the Judgment and Order of acquittal, so far as relates to the respondent No.2 i.e. original accused No.2-Nivarutti Narayan Jagtap, is proper and legal and is not sought to be appealed against.

So far as the respondent No.1 is concerned, I think it proper to grant leave to appeal from his acquittal. 3.

Leave to file an appeal, so far as it relates to the acquittal of the respondent No.1 (original accused No.1), granted. Gaikwad RD 1/2

The application for leave to appeal be treated as a memo of appeal and be numbered accordingly. Necessary amendment be carried out within two weeks.

The appeal is admitted.

Action under Section 390 of the Code of Criminal Procedure be taken by issuing a bailable warrant in the sum of Rs.10,000/- against the respondent No.1.
