Heard the learned counsel for the applicant and the learned A.P.P.

On the last date, the learned APP had submitted that the application for bail filed by the present applicant is pending before the Special Judge (MCOC), Pune. Today, the learned counsel for the applicant submits that the applicant has filed an application before the Sessions Judge at Pune on 23rd May 2017 under Section 439 Cr.P.C.. The applicant is being prosecuted under the provisions of MCOCA. The application is still pending before the Sessions Court. In view of this, the learned counsel for the applicant seeks direction to the Sessions Court to dispose of the bail application at the earliest.

Dusane 2/2 2 ba 2614.2017 Considering the submissions of the learned counsel as well as the dictum of the Hon'ble Apex Court in the case of Hussain and Another Vs. Union of India, reported in A.I.R., 2017 Supreme Court, page 1362, this Court would direct the Special Judge seized with MCOCA Special Case No. 11 of 2017 to decide the criminal application filed by the applicant below Exhibit 34 within four weeks from the date of receipt of this order.

With this direction, the present application stands disposed of.
