Learned counsel appearing for the petitioners on instructions of the petitioners seeks permission to withdraw the petition with liberty to file a declaratory suit. She prays that directions may be given to expedite the suit.

rpa 2/2 wp-12209-15.doc The petition is accordingly disposed of as withdrawn with liberty, as prayed. Though, considering the conduct of the first petitioner, she is not entitled to any equitable relief, considering the larger interests of the minor, if a suit is filed by the petitioners, the trial Court shall give necessary priority to the disposal of the suit.

All contentions on merits are also kept open.
