P.C. :- This is an Application filed by the Applicant seeking suspension of the substantive sentence of imprisonment and his enlargement on bail pending the decision of the Appeal. 2.

The learned Counsel for the Applicant states on instructions that he does not press for the relief prayed for in this Application and prays for withdrawal of this Application. 3.

Accordingly, Criminal Application is dismissed as withdrawn.

We have heard Mr. Bhatt, learned Counsel for the Applicant and the learned APP. With the assistance of the learned

APPA 1613.14.sxw Counsel for the parties, we have perused not only the findings recorded by the Trial Court but also the evidence of the parties. Upon such perusal, in our opinion, this would be a fit case for deciding the Appeal out of turn. The learned Counsel for the Applicant has already submitted a skeleton paper-book comprising the depositions of the witnesses. In that light of the matter, we dispense with the preparation of a formal paper-book. We direct the Registry to call for R. & P. and to ensure that the R. & P. is received within 2 weeks from today.
