Applicant is seeking his enlargement on bail in connection with C.R. No.466/2017 registered with Khadak Police Station, Pune for the offences punishable under Sections 394, 395, 397 r/w 34 of the Indian Penal Code, 1860 and Section 4(25) of Arms Act and Section 37(1) r/w 135 of Bombay Police Act.

Learned counsel has relied on the order passed by this Court in Bail Application No.

2436/2018 and 1048/2019 whereby the co-accused were directed to be released on bail.

I have perused the orders as well as final report.

The role attributed to the applicant is the same which has been attributed to co-accused Suraj and Yogesh, who were directed to be released on bail.

In view of the aforesaid facts, following order.

O R D E R

i.

The applicant arrested in No.466/2017 registered with Khadak Police Station, Pune is directed to be released on bail on furnishing P.R. Bond of Rs. 25,000/- (Rs. Twenty Five Thousand only) with one or two sureties in the like sum.

The applicant shall attend the concerned Police Station on every 1st Monday of the month between 10.00 am. to 2.00 pm. commencing from April, 2020 and join the process of investigation till the framing of charge.

iii.

The applicant shall also attend all the dates before the trial Court.

iv.

The applicant shall furnish the particulars of his place of residence and contact details to the Investigating Officer of the Police Station concerned within seven days from his release.

v.

The applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

Application is allowed in the aforesaid terms.

It is made clear that observations made hereinabove shall be construed as expression of opinion only for the purpose of granting bail and the same shall not in any way influence the trial in other proceedings.
