Heard the Learned Advocates appearing for the parties. Following order is passed, by consent :- (a) The President, Industrial Court, Maharashtra, Mumbai shall endevour to dispose off the Complaint (ULP) No.300 of 2017 and Complaint (ULP) No.306 of 2017 within a period of ten weeks from the date of this order. (b) The President, Industrial Court, Maharashtra, Mumbai shall hear the complaints and pass appropriate orders without being influenced by the reasoning

kpd 2 / 2 933-WP-12819-2017.sxw given in the order dated 10th October, 2017 passed by the Industrial Court, Maharashtra, Mumbai in Complaint (ULP) No.300 of 2017. (c) All contentions of the parties including the contentions of the Respondents that the issues raised in Complaint (ULP) No.300 of 2017 and in Complaint (ULP) No.306 of 2017 are different and independent, are kept open. (d) The parties and/or their Advocates shall appear before the President, Maharashtra, Mumbai on 27 th November, 2017 at 11.00 a.m. and after producing a copy of this order obtain necessary directions in the matter. (e) The parties shall not seek adjournment/s unless absolutely necessary. The President, Industrial Court, Maharashtra, Mumbai shall also not adjourn the proceedings unless absolutely necessary.

In view of this order, the above Writ Petition as well Writ Petition (St) No.31668 of 2017 which is not on board stands disposed off. ( S.J.KATHAWALLA, J. )
