Upon learned APP, on instructions from the I.O. present in Court, making a statement that charge-sheet would be filed in this case on or before 22-1-2015, the learned counsel for the applicant has sought leave to withdraw the application with liberty to approach the Court

sjs 11-BA-2623.2014 of Sessions for bail and with further liberty to apply for revival of this application in the event of the I.O. not adhering to the statement made.

In the circumstances, the application is disposed of as withdrawn with liberty to the applicant to approach the Court of Sessions for bail after the charge-sheet is filed. In the event of such an application being preferred, the Court of Sessions shall decide the same in accordance with law and uninfluenced by the fact of withdrawal of this application by the applicant.

In the event of failure of the I.O. to file the charge-sheet, as informed, liberty to the applicant to apply for revival of this application.
