This is an application under Section 439 Cr.P.C. filed by the aforesaid applicant, who is facing trial in Sessions Case No. 762 of 2021 pending on the file of 23rd Sessions Court, Gr. Mumbai. 2.

Learned APP states that the trial is at fag end. Only one or two witnesses have remained to be examined. In the light of the said statement, I am not inclined to entertain this application at this stage.
