This petition impugns the order passed by the Additional Sessions Judge in Misc. Application No. 254 of 2007 in Sessions Case No. 888 of 1996. Petitioner was one of the witnesses in Sessions Case No. 888 of 1996. The property seized during the course of investigation was recovered from the petitioner. He has prayed for return of the property on execution of the bond.

24-wp-4206.2012.sxw The said application was rejected by the Sessions Court. Therefore, he has moved this court by way of the present writ petition. 4.
I do not think, it is is necessary to go into the merits of the case in as much as the original complainant had also filed Criminal Revision Application against the order of the Sessions Court rejecting his prayer for return of the property. This court by its order dated 21st November, 2012 in Criminal Revision Application No. 222 of 2010 (K.U. Chandiwal,J.) has directed return of the property to the complainant Patel Madhavlal Maganlal and Co. on execution of bond to the extent of value of the property with certain conditions. Therefore, the present writ petition becomes infructuous. Petition stands disposed of as infructuous.
