P.C.:- By an Order dated 25th October, 2018, the Applicant was granted interim relief and was directed to attend the Investigating Officer on stipulated dates, to join the process of investigation. Heard the learned counsel appearing for the Applicant and the learned APP. Perused the record of investigation. The learned APP, on instructions from the Investigating Officer, submitted that the Applicant has complied with the said conditions. The record of investigation indicates that Smt. Asma alias Yasmin alias Zoya Khan who had prepared the key of the cupboard of the first informant has not been arraigned as an accused till date. The key maker in his statement has stated that the Smt. Asma alias Yasmin 1/2

ssm 2 15-aba2182.18.doc alias Zoya Khan had been to him to prepare a duplicate key. Prima facie, it appears that the Investigating Agency till date, has not collected sufficient material against the Applicant showing his complicity in the offence.

In view of the above, interim relief granted by Order dated 25th October, 2018 is hereby confirmed. However, the condition to attend the Investigating Officer of the concerned Police Station is waived.
